3E Company Strengthens Specialized GHS Practice to Support Corporate Conformance with OSHA’s New Hazard Communication Standard 2012

OSHA published the Hazard Communication Standard 2012 in the Federal Register on March 26, 2012, with the final rule affecting millions of workplaces and having a profound effect on the supply chain. HCS 2012 introduces a set of criteria for classifying human health and physical hazards, as well as OSHA-defined hazards and hazards not otherwise classified (HNOC), which has far-reaching implications for the data contained within Safety Data Sheets (SDSs) and product labels. Many companies will need to reclassify their hazardous materials and capture additional data for publication on labels and SDSs. In many instances, SDSs and labels will need to be re-authored to conform to the new guidelines set forth in HCS 2012.

3E Company Announces New Exposure Scenario Authoring Service to Facilitate REACH Conformance

3E Company, a leading provider of environmental health and safety (EH&S) compliance and information management services, today announced its new Exposure Scenario Authoring Service, aimed at streamlining conformance with Europe’s Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) regulatory framework. The new service alleviates the burden of producing lengthy and complex exposure scenarios (ES) and extended Safety Data Sheets (eSDS) documents and enhances product stewardship quality and productivity.

Under REACH guidelines, companies supplying 10 tons or more per year of a hazardous substance must provide exposure scenarios as an integrated part of their Safety Data Sheets (SDS). The new, longer document, known as an eSDS, must cover all “identified uses” of a substance throughout its life cycle. An ES must include risk assessments for every use to ensure the substance is properly controlled at all times.

The ES, as defined by the European Chemicals Agency (ECHA), consists of four sections, all requiring detailed explanations: Exposure Scenario Scope; Contributing Exposure Scenarios for controlling environmental, worker, and consumer exposure; Exposure Estimation; and Guidance to Downstream Users. Given the vast amount of information required to ensure conformance, 3E Company anticipates that the creation of exposure scenarios will be an additional source of concern for manufacturers and distributors already struggling to comply with rapidly evolving global regulations.

3E’s Exposure Scenario Authoring Service eases the burden by facilitating the creation of accurate and reliable exposure scenarios for pure substance products as well as for individual components in a mixture. The eSDS’s exposure scenarios are provided either as separate documents or attached to and integrated within part of the European SDSs.

3E Company’s MSDgen 6.06 Streamlines REACH Conformance with Enhanced eSDS and Exposure Scenario Development Capabilities

The new version enables users to more productively develop and distribute compliant and reliable hazard communication documents that conform to today’s rapidly evolving and complex regulatory requirements, including Europe's Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) regulatory framework.

MSDgen 6.06 addresses the new requirement to produce REACH Exposure Scenarios (ES) while alleviating other burdens for manufacturers and distributors already struggling to conform to REACH’s initial requirements. To facilitate the development of the ES component of the newly required extended Safety Data Sheets (eSDSs), MSDgen 6.06 offers users several enhanced features to help develop, maintain, and distribute these complex documents. These features include the ability to automatically append externally authored ESs to SDSs that are authored and stored in MSDgen, thus streamlining the management and distribution of the new documents.

MSDgen 6.06 supports the European Chemical Industry Council (CEFIC) ESCom Standard Phrase Library with the addition of a new function that allows users with licensed ESCom library and translation content packages to assign statements into the desired MSDgen section and subsection glossary structures. Mapping these statements greatly accelerates a company’s ability to author eSDSs and provide the required language translations. This new mapping feature allows users to adjust or create their own unique mappings that suit their products and compliance needs. The framework allows customers to configure and tailor their systems, while remaining compatible with future library releases and ensuring proper compatibility with future initiatives.

MSDgen 6.06 also aligns with the European Chemicals Agency (ECHA) SDS Guidance version 1.0, which was published in September 2011. This includes the numbering of specific subsections throughout the 16 sections of the SDS. Various aspects of Commission Regulation (EU) No 286/2011 and the second Adaptation to Technical Progress (ATP) to the CLP Regulation have been incorporated as well, including changes to the sensitizer and ozone hazards. The implementation of these two important regulatory documents enables users to produce compliant SDSs that are up to date with the most recent EU requirements.

Other new features include support for:

Datamatrix barcodes and Quick Response codes on labels
updated Japanese MSDS templates that conform to the country’s Chemical Substance Control Law
reformatted toxicological and eco-toxicological data tables on all templates based on expert review
modifications to Section 9 of all templates to allow printing of exponential notation and enhancements to the associated property printing
additional statements in Section 11 for glossary assignment when there is inconclusive data or no data for classification
modifications to Section 14 of all templates to enable users to print from a new Transport Print Control Module and more easily analyze and change the way transport data appears on documents. As part of the updates, MSDgen now also allows the printing of subsidiary, tertiary, quaternary, and marine pollutant hazard class symbols.
